Rajiv Gandhi assassins to stay in jail, case referred to a larger constitutional bench: SC


NEW DELHI: The Supreme Court on Friday referred the case related to the release of those convicted of the murder of former Prime Minister Rajiv Gandhi to a larger constitution bench. The convicts will not be released from prison till further orders, the court said.

A bench headed by Chief Justice P Sathasivam delivered the judgment at 10.30am on Friday. The apex court bench framed several questions to be addressed by the five-judge constitution bench, including after commutation of the death sentence into life imprisonment whether the government can further grant them remission by releasing them.

The Supreme Court said that the constitution bench will also address which government has the power to exercise remission for condemned prisoners under the code of criminal procedure; whether it is the state government or the central government or both.
Former Prime Minister Rajiv Gandhi was assassinated at Sriperumpudur near Chennai in Tamil Nadu on May 21, 1991. A special court for Terrorist and Disruptive Activities (Prevention) Act (POTA) found all the 26 persons guilty of the offence and awarded them death sentence in January 1998. On a referred appeal before the Supreme Court, the death penalties of only four, Nalini, Murugan, Santhan and Perarivalan, were confirmed. Later, on the recommendation of the Tamil Nadu cabinet, the state's governor commuted the death penalty of Nalini alone into imprisonment for life.

Meanwhile, the mercy pleas of the three condemned persons pending before the President for more than 11 years were rejected, and their hanging was scheduled to be held in September 2011. It was, however, stayed by the Madras high court.

On February 18 this year, the apex court commuted their death sentence into imprisonment for life, saying inordinate and unexplained delay in disposing of their mercy pleas by the President would be a valid ground for commuting their sentence.

24 Indians arrested in Singapore after riots


Twenty-seven South Asian workers, including 24 Indians, were arrested Monday for alleged rioting in Singapore as its Prime Minister ordered a probe into the country's worst outbreak of violence in over 40 years.

Besides the Indians, two Bangladeshis and one Singapore permanent resident, whose origin was not known, were also arrested for Sunday night's rioting, triggered by a road accident that killed an Indian worker.

At least 18 people, including 10 policemen, were injured when some 400 people attacked the police and damaged 16 vehicles in an Indian district here, police said.

The trouble started after a private bus fatally knocked down an Indian pedestrian, 33-year-old Sakthivel Kumaravelu, around 9:20pm at the junction of Race Course Road and Hampshire Road in Little India, a precinct of Indian-origin businesses, eateries and pubs where most of the South Asian workers take their Sunday break, they said.

All the 27 arrested are in the age-group of 23-45 and face charges under "rioting with dangerous weapons", punishable by up to seven years in prison as well as caning.

The Indian High Commission in Singapore said it was calling on all parties to remain calm following the riot. "We understand the situation is under control and Singapore authorities have appealed for maintaining calm by all sections of society. We hope all parties will maintain calm," said the High Commission in a statement.

PM Lee Hsien Loong conveyed his deepest condolences to the family of Kumaravelu and ordered a probe into the incident. "I also offer my deepest condolences to the family of Mr Sakthivel Kumaravelu, who was killed in the traffic accident that preceded the riot.

"I have directed the Ministry of Home Affairs to convene a Committee of Inquiry (COI) to look into this serious incident. The COI will look into the factors that led to the incident and how the incident was handled on the ground," Lee said in a statement.
